US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Detention
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without lawful basis.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The case stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to answer alien smuggling allegations, he was held in immigration detention.
In her decision, the court noted that the government lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The legal challenge center on disputed claims. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.
Conditions of Release
The judge, who was overseeing his challenge to removal in a federal court, determined that he must now comply with the conditions of his release from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
This decision marks a significant development in a complicated immigration case involving claims of mistaken imprisonment and contested criminal affiliations.
